Cancellation Policy
How cancellation of a signed construction or interior project with CDEF Buildcon is handled, including refunds and material costs.
Draft for review. This policy, including every number below, is a draft template and must be reviewed and finalised by CDEF Buildcon's management and legal counsel - and reflected in the client's signed project agreement - before publication or use.
1. Scope
This policy applies to a project already covered by a signed written agreement with CDEF Buildcon Pvt. Ltd. (residential construction, commercial construction or interior design). It does not apply to a free initial consultation or site visit, which carries no cost or obligation and can be ended at any time without any process below.
2. How to Request Cancellation
To cancel a signed project, the client (or an authorised representative) must send a written cancellation request to their CDEF project lead, or to info@cdefbuildcon.com, stating the project reference, reason for cancellation, and preferred contact number. A verbal request alone is not treated as a formal cancellation.
3. Acknowledgement & Review
We acknowledge a cancellation request within [draft: 3 business days] of receipt. Our project lead and accounts team then review the project file - work completed to date, materials already procured, and payments received against agreed milestones - and share a written cancellation settlement statement with the client.
4. Basis for Cost Deductions
Where a project is cancelled after work has begun, the refundable portion of any advance is calculated after deducting:
- The value of work already completed, assessed against the milestone stage reached (e.g. foundation, structure, finishing) as defined in the signed agreement
- The cost of materials already procured or ordered specifically for the project (see Section 5)
- Any site mobilisation, demobilisation or standby labour cost directly resulting from the cancellation
- A cancellation processing charge of [draft: 2% of the total contract value], intended to cover administrative and scheduling costs
The resulting settlement statement shows the deductions and the refundable balance, if any, in writing before any refund is processed.
5. Materials Already Procured
Project-specific materials already purchased, ordered or fabricated to your specification (for example, custom modular furniture, specific tiles or fittings already placed on order) are generally non-refundable once ordered, and may be handed over to the client at the client's option and cost of transport. Standard, unopened stock materials not yet specific to your project may be returned to the supplier where possible, and any recoverable value is credited back as part of the settlement.
6. Refund of Unutilized Advance
Where the settlement statement shows a refundable balance, CDEF Buildcon processes the refund to the original payment source (or another method agreed in writing) within [draft: 10 business days] of the client countersigning the settlement statement.
7. Payments Already Due at a Reached Milestone
If a project is cancelled after a milestone has been completed but before the related milestone payment has been made, that payment remains due and is adjusted against the final settlement, consistent with the project agreement's payment schedule.
8. Disputes & Escalation
If a client disagrees with the settlement statement, they may raise the specific line items in dispute, in writing, within [draft: 7 business days] of receiving it. Unresolved disputes are escalated to CDEF Buildcon's management for review, and if still unresolved, are handled as set out in the Governing Law clause below and in the signed project agreement.
9. Governing Law
This policy and any cancellation settlement are governed by the laws of India, with the courts at Gautam Buddha Nagar, Uttar Pradesh having exclusive jurisdiction, subject to any dispute-resolution clause in the client's specific signed project agreement.
10. Relationship to Your Project Agreement
This page describes our general cancellation approach. Your specific signed project agreement may include additional or more specific terms for your project - where the two differ, your signed project agreement governs. See also our Terms & Conditions and FAQ for related information on payment structure and warranty.
